Vigezo na Masharti ya Huduma za Mtandao
Vigezo na masharti haya yanahusu matumizi yako ya huduma za mtandao zinazotolewa na Banana Brands Limited (Wifi Poa Networks).
1. Kukubali Masharti
1.1 Kwa kujisajili na kutumia huduma za mtandao zinazotolewa na Banana Brands Limited (Wifi Poa Networks), unakubali kutii na kufungwa na vigezo na masharti haya.
1.2 Banana Brands Limited (Wifi Poa Networks) inahifadhi haki ya kubadilisha, kusasisha au kurekebisha vigezo hivi wakati wowote. Taarifa ya mabadiliko itatolewa kupitia njia stahiki, na kuendelea kutumia huduma baada ya mabadiliko kutachukuliwa kuwa umekubali masharti mapya.
2. Huduma
2.1 Banana Brands itatoa huduma za mtandao zikiwemo upatikanaji wa intaneti, utumaji data, na huduma zinazohusiana, kulingana na masharti haya.
2.2 Ubora na kasi ya huduma inaweza kutofautiana kutokana na sababu zilizo nje ya uwezo wetu kama vile msongamano wa mtandao, changamoto za kiufundi na usumbufu wa nje.
3. Wajibu wa Mteja
3.1 Mteja anawajibika kulinda usalama wa vifaa vyake vya kufikia mtandao, ikiwemo ruta, modemu na nywila.
3.2 Mteja atatii sheria zote zinazotumika na kuepuka shughuli zisizo halali, za kuharibu au zinazohatarisha usalama wa mtandao.
3.3 Utunzaji wa Vifaa Vilivyokodishwa/Kuazimwa: Ambapo vifaa (k.m. router, modem, CPE/ONU) vimekodishwa/kuazimwa kwa mteja, mteja atavitunza kwa uangalifu mzuri wa kawaida (“reasonable care”) na atavitumia tu kwa madhumuni ya huduma.
3.4 Haki ya Kuchukua Vifaa: Wifi Poa Networks inahifadhi haki ya kurejesha/kuchukua vifaa vilivyokodishwa/kuazimwa wakati wowote endapo mteja hataendelea kufanya manunuzi/malipo ya huduma au akivunja mkataba huu.
3.5 Uharibifu kwa Uzembe: Endapo kutatokea uharibifu, upotevu au wizi wa vifaa kutokana na uzembe, kutozingatia maelekezo ya matumizi au matumizi yasiyoruhusiwa, mteja atawajibika kulipia gharama ya ukarabati au uingizwaji wa kifaa kama itakavyobainishwa na Wifi Poa Networks.
3.6 Urejeshaji wa Vifaa: Baada ya kusitisha huduma, mteja atarejesha vifaa vyote vya Wifi Poa katika hali nzuri ya kazi isipokuwa uchakavu wa kawaida.
4. Malipo
4.1 Mteja anakubali kulipa ada kulingana na kifurushi alichochagua, ikijumuisha ada za kila mwezi, matumizi, na huduma za ziada.
4.2 Mzunguko wa bili, njia za malipo na adhabu za kuchelewa zitaainishwa kwenye Mkataba wa Huduma za Mtandao kati ya pande husika.
5. Upatikanaji wa Huduma na Matengenezo
5.1 Tutajitahidi kuhakikisha upatikanaji endelevu wa huduma; hata hivyo huduma zinaweza kusimamishwa kwa matengenezo, maboresho au sababu nyinginezo. Taarifa ya kusimamishwa itatolewa pale inapowezekana.
5.2 Hatutawajibika kwa hasara yoyote inayotokana na kusitishwa au hitilafu za mtandao zilizo nje ya uwezo wetu wa kawaida.
6. Faragha na Usalama wa Data
6.1 Tuta kusanya na kuchakata taarifa za Mteja kulingana na sera yetu ya faragha iliyo kwenye tovuti.
6.2 Mteja awajibike kulinda data zake, ikiwa ni pamoja na kutumia usimbaji (encryption) inapofaa.
7. Usitishaji wa Huduma
7.1 Tuna haki ya kusitisha au kusimamisha huduma endapo Mteja atavunja masharti haya au kuhatarisha usalama/uweledi wa mtandao.
7.2 Mteja anaweza kusitisha huduma kwa kutoa taarifa kama ilivyoainishwa kwenye Mkataba wa Huduma za Mtandao.
8. Kizuizi cha Uwajibikaji
8.1 Hatutawajibika kwa uharibifu wa moja kwa moja au usio wa moja kwa moja unaotokana na matumizi au kushindwa kutumia huduma.
8.2 Uwajibikaji wetu wa jumla hautazidi jumla ya ada ulizolipa kwa huduma husika iliyosababisha dai.
9. Sheria Inayotumika na Utatuzi wa Migogoro
9.1 Masharti haya yanasimamiwa na sheria za Jamhuri ya Muungano wa Tanzania. Migogoro itatatuliwa kwa mazungumzo/usalama (mediation) ndani ya siku 30; ikishindikana, pande zinaweza kuwasilisha shauri mahakamani ndani ya Jamhuri ya Muungano wa Tanzania.
10. Mambo Mengineyo
10.1 Hati hii ni makubaliano kamili kati ya Mteja na Banana Brands Limited (Wifi Poa Networks) na inabatilisha makubaliano yaliyotangulia.
10.2 Iwapo kifungu chochote kitakuwa batili, kisichotekelezeka au kisicho halali, vifungu vilivyosalia vitaendelea kutumika mradi batilisho hilo haliharibu kiini cha makubaliano haya.
11. Haki ya Kubadilisha Masharti
11.1 Banana Brands Limited (Wifi Poa Networks) inahifadhi haki ya kubadilisha au kusasisha masharti haya wakati wowote. Mabadiliko yataanza kutumika mara baada ya kuchapishwa au kutoa taarifa kupitia njia za mawasiliano zilizokubaliwa. Kuendelea kutumia huduma kutachukuliwa kuwa umekubali mabadiliko hayo.
Kwa kutumia huduma za Wifi Poa Networks, unathibitisha kuwa umesoma, umeelewa na unakubali vigezo na masharti haya.
Terms and Conditions for Network Services
These terms and conditions govern your use of network services provided by Banana Brands Limited (Wifi Poa Networks).
1. Acceptance of Terms
1.1 By subscribing to and using services provided by Banana Brands Limited (Wifi Poa Networks), you agree to comply with these Terms.
1.2 Banana Brands Limited (Wifi Poa Networks) reserves the right to update or revise these Terms at any time. Notice will be provided through appropriate channels, and continued use after changes constitutes acceptance of the revised Terms.
2. Services
2.1 We provide internet access, data transmission, and related services subject to these Terms.
2.2 Service quality and speed may vary due to factors beyond our control, including network congestion, technical limitations, and external interference.
3. Subscriber Responsibilities
3.1 You are responsible for the security of your access devices, including routers, modems, and passwords.
3.2 You must comply with all applicable laws and refrain from illegal, harmful, or disruptive activities.
3.3 Care of Leased/Loaned Devices: Where devices (e.g., router, modem, CPE/ONU) are leased or loaned to you, you shall keep them with reasonable care and use them only for the Service.
3.4 Right to Repossess: Wifi Poa Networks reserves the right to repossess leased/loaned devices at any time if you are not making purchases/payments for the Service or if you are in breach of this Agreement.
3.5 Damage Due to Negligence: In case of damage, loss, or theft of the devices caused by negligence, misuse, or failure to follow instructions, you will be liable for repair or replacement costs as determined by Wifi Poa Networks.
3.6 Return of Devices: Upon termination of the Service, you will return all Wifi Poa devices in good working condition, fair wear and tear excepted.
4. Billing and Payments
4.1 You agree to pay fees associated with your selected plan, including monthly charges, usage, and optional services.
4.2 Billing cycles, payment methods, and late payment penalties are set out in the Network Provision Service Agreement between the parties.
5. Service Availability and Maintenance
5.1 We will use reasonable efforts to ensure continuous availability; however, services may be interrupted for maintenance, upgrades, or other reasons. Notice of planned downtime will be provided where possible.
5.2 We are not liable for losses arising from interruptions or outages beyond our reasonable control.
6. Privacy and Data Security
6.1 We collect and process subscriber information in accordance with our Privacy Policy available on our website.
6.2 You are responsible for securing your data and are encouraged to use encryption and other safeguards.
7. Termination of Services
7.1 We may suspend or terminate the Service if you violate these Terms or compromise the integrity or security of the network.
7.2 You may terminate the Service by giving notice as set out in the Network Provision Service Agreement.
8. Limitation of Liability
8.1 We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from use or inability to use the Service.
8.2 Our total liability shall not exceed the total fees paid by you for the specific service giving rise to the claim.
9. Governing Law and Dispute Resolution
9.1 These Terms are governed by the laws of the United Republic of Tanzania. Disputes shall be resolved amicably through mediation within 30 days; failing which, the matter may be referred to a competent court in Tanzania.
10. Miscellaneous
10.1 These Terms constitute the entire agreement between you and Banana Brands Limited (Wifi Poa Networks) and supersede prior agreements.
10.2 If any clause is held invalid or unenforceable, the remaining provisions shall continue in full force and effect unless the invalidity goes to the root of this Agreement.
11. Right to Change the Terms
11.1 Banana Brands Limited (Wifi Poa Networks) reserves the right to change or update these Terms at any time. Changes take effect upon publication or notice via agreed communication channels. Continued use of the Service constitutes acceptance of the changes.
